Woollahra Council Tree Rules & Regulations

Woollahra Municipal Council regulates tree pruning, removal and protection under Clause 5.9 of the Woollahra LEP 2014 and Chapter E3 – Tree Management of the Woollahra DCP.

Most work involving protected trees requires approval through either a Tree Works Application or, in some circumstances, a Development Application.

Arbor Express prepares AQF Level 5 Arborist Reports that help homeowners, builders, architects and developers satisfy Woollahra Council's planning requirements.

  • Approval is generally required where a tree exceeds 5 metres in height or has a crown spread greater than 3 metres, regardless of height.
  • A Development Application, rather than a Tree Works Application, is required where the tree must be retained under an existing Development Consent, is listed as an Environmental Heritage Item, or appears on Woollahra Council's Significant Tree Register.
  • Chapter E3 identifies several exemptions, including certain listed species and removal of deadwood. Exemptions do not apply to heritage-listed or Significant Tree Register trees.
  • Where a Development Application may affect existing trees, Council requires tree information prepared in accordance with its DA Guide and Attachment 4 (Tree Reports). Depending on the proposal, this may include a Tree Protection Plan, Construction Impact Statement, Root Mapping Report or Tree Management Report.
  • Where tree removal is approved, Council may impose replacement planting conditions to maintain the municipality's urban tree canopy, assessed according to the individual circumstances of each application.

Do I need Council approval to remove a tree?

In most situations, yes. Trees greater than 5 metres in height, or with a crown spread exceeding 3 metres, generally require either a Tree Works Application or a Development Application before removal or major pruning.

Is my tree exempt from Council approval?

Chapter E3 of the Woollahra DCP identifies several exempt species and works, including removal of deadwood. Exemptions do not apply to trees listed on the Significant Tree Register, heritage-listed trees or trees retained under an existing Development Consent. We can confirm whether your tree is exempt before any work begins.

What does an Arborist Report include?

Depending on the purpose of the report, it may include a tree health and structural assessment, retention recommendations, impact assessment and tree protection measures tailored to support a Development Application, Tree Works Application or Health & Safety assessment.
